A preliminary hearing date still remains pending for a 55-year-old Vacaville man charged with a dozen counts of sending or possessing child pornography. Edgar “Cataleya” Aguirre appeared Thursday morning in Solano County Superior Court for a scheduled hearing setting and a preplea report. However, at the request of his defense attorney, Harris B. Taback, Judge Stephanie Grogan Jones reset it for 8: 30 a. m. Dec. 11 in Department 12 in the Justice Center in Fairfield. Solano County Deputy District Attorney Carolyn L. Gylling represented the DA’s Office. Aguirre, who was arrested in April, remains out of custody on a $45,000 bond and a pretrial services contract. Court records show he is charged with 10 counts of sending or selling obscene matter depicting a minor; one count of sending or possessing obscene matter; and one count of possessing obscene matter of a minor in a sexual act. During the brief morning proceeding, Judge Grogan Jones indicated she had read and considered the Probation Department’s report and “made no promises about jail time,” according to wording in official court records. Taback indicated he would file relevant documents in the case, and the judge told him to file them under seal with clerk’s office. As previously reported, at one of Aguirre’s first court proceedings, Judge Wendy Getty, who was hearing the matter at the time, considered a no-bail ruling, based on factors presented in the charges against Aguirre. “Out of an abundance of caution, these factors have to be overcome to ask for a different bail order,” she noted at the time. Aguirre’s defense attorney at the time, Rabin Nabizadeh, argued that the normal bail schedule for such cases is $45,000 and said he had seen far worse allegations in state and federal cases he has defended with none having no-bail holds on a defendant. He added that there is no indication that Aguirre ever harmed a child. He said his client has ties to the community, is in a longtime relationship and doesn’t present a flight risk. Getty noted that details of the ties to the community and financial ability to set up bail and a bail bond was recorded with the court on April 29. Aguirre was arrested April 3, when a search warrant was served at his Vacaville home in the 7000 block of Paddon Road by a team of law enforcement officials who had received a tip. The team consisted of the Solano County Sheriff’s Office Investigations Bureau, Solano County Sheriff’s Enforcement Team, California Highway Patrol Computer Crimes, and Vacaville Police Department detectives.
