**Mumbai: Charges Framed Against Remaining Accused in 2019 Gadchiroli Naxal Attack Case**
Paving the way for the trial against the accused booked in connection with the 2019 Gadchiroli Naxal attack, the court on Friday framed charges against the remaining four of the eight accused. These four had earlier challenged the applicability of the provisions of the Maharashtra Control of Organised Crime Act (MCOCA) to the case.
### Supreme Court Intervention
This development follows the intervention of the Supreme Court last month, which set aside the Bombay High Court’s order that had discharged the accused from the provisions of MCOCA. The prosecuting agency had challenged the High Court’s decision before the Apex Court.
### Background of MCOCA Applicability
The charges under MCOCA were initially dropped after the court noticed that, in one of the cases cited for prior criminal antecedents, the respective courts had not taken cognisance of the chargesheets filed by the prosecution. The Bombay High Court had upheld this view and stated that the charges of MCOCA were not applicable.
However, the Supreme Court clarified in its order dated September 16 that, “Taking cognisance in the prior cases merely gives a right to the authority to take appropriate action under the Maharashtra Control of Organised Crime Act, 1999.”
### Accused Now Facing MCOCA Charges
Following the Apex Court’s order, the special NIA court framed charges on Friday against Sathyanarayana Rani alias Kiran, Parasram Tulavi, Somsay Madavi, and Kisan Hidami. All accused will now be charged under the provisions of MCOCA as well.
### Earlier Charges Framed
The charges against the other four accused—namely Dilip Hidani, Sukharu Ramsay Gota alias Sakru Gota, Kailash Premchand Ramchandani alias Gurunanak, and Dinkar alias Shivram Bikaru Gota alias Salim—were framed earlier in May 2024.
